Terms of Service
Effective Oct 16, 2026
1. Agreement and eligibility
These Terms of Service ("Terms") are an agreement between you and BEND Creative Inc., operating as TextApprentice ("TextApprentice", "we", "us"). They govern your use of the TextApprentice missed-call text-back service, dashboard and website (the "Service").
By checking the box at sign-up, submitting our intake form, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
The Service is for businesses, not consumers. You confirm that you are at least 18, that you are signing up on behalf of a business, and that you have authority to bind that business. "You" means that business and the person who accepts these Terms for it.
2. The Service
When you do not answer a call, your carrier forwards it to a TextApprentice number. The caller hears a greeting and receives an automatic text from your business. Their reply is forwarded to you, and you can see missed calls and replies in your dashboard.
- We set up your greeting and message wording with you on a setup call. You approve that wording before it goes live. Every text is pre-written; no messages are generated by AI.
- You turn the Service on by dialing a conditional call-forwarding code on your phone. You can turn it off the same way at any time.
- While the Service is on, unanswered calls go to us instead of your voicemail, unless we have set up a voicemail option for you.
TextApprentice is a messaging tool. It does not answer calls live, book jobs, quote prices or give advice on your behalf. You are responsible for following up with every customer.
3. Your responsibilities
You are the sender of the texts that go to your callers, and you are responsible for how the Service is used under your account. You agree to:
- Give us accurate business details and keep them up to date.
- Only forward phone numbers that your business owns or is authorized to use.
- Use the Service only to respond to people who called your business, and only about their inquiry.
- Comply with Canada's Anti-Spam Legislation (CASL), CRTC rules, carrier messaging rules and privacy laws when you follow up with callers.
- Honour opt-outs. If a caller replies STOP, we will stop texting them from your number, and you must not text them again about it through the Service.
- Keep your dashboard login private and tell us right away if you think someone else has accessed it.
You must not use the Service to:
- send marketing, promotions or bulk messages to people who did not call you
- send messages that are false, misleading, harassing, threatening, hateful or unlawful
- impersonate another business or person
- collect payment card numbers, banking details, government ID numbers or health information by text
- interfere with the Service, our providers or our network, or try to access other clients' data
4. Messages, caller data and privacy
You own your business information, your message wording, and the call records and replies from your callers ("Your Data"). You give us permission to store, process and transmit Your Data only to run, support and improve the Service.
- We handle personal information as described in our Privacy Policy and under Canada's privacy laws (PIPEDA).
- For caller information, you decide why it is collected and how you use it. We process it on your behalf.
- Every first text to a caller includes STOP opt-out language. Callers can reply HELP for contact information. Standard message and data rates may apply to callers.
- After you cancel, you can ask us for an export of your call records within 30 days. We delete Your Data within 90 days of cancellation, unless the law requires us to keep it longer.
- We may use anonymized, aggregated data (for example, average reply rates) to improve the Service. It will never identify you or your callers.
We own the Service, the TextApprentice name and logo, and our software and website. These Terms do not give you any rights to them beyond using the Service while your account is active.
5. Plans, trial and billing
All prices are in Canadian dollars and do not include applicable taxes (HST/GST/PST), which we add to your invoice.
| Plan | Price | What's included |
|---|---|---|
| Starter | $50/month + $5 per recovered call | First 30 days: $0 base fee; recovered-call fees still apply |
| Unlimited | $199/month | All recovered calls included |
| Annual | $1,990/year | All recovered calls included, billed once a year |
The 30-day $0 base fee applies to the Starter plan only, once per business. You can switch from Starter to Unlimited or Annual at any time, and the new plan starts at your next billing date.
- A "recovered call" is a missed call where the caller replied to our text. No reply, no charge. Our system records are used to count recovered calls.
- Monthly base fees are charged on the 1st of each month, in advance. Recovered-call fees for the previous month are charged on the same day.
- You authorize us to charge the payment method on file for all fees when due. If a payment fails, we will email you. If it is not fixed within 14 days, we may suspend the Service until it is paid.
- We may change our prices with at least 30 days' written notice. A new price takes effect at your next billing period. Annual prices are locked for the year you have paid for.
6. Cancellation and refunds
Monthly plans have no long-term contract. Cancel by emailing info@textapprentice.com with at least 14 days' notice. You pay for the Service through the end of that notice period, including any recovered-call fees.
- Annual plans run for the full year you paid for. You can cancel renewal at any time with 14 days' notice before the renewal date. We do not give refunds for unused months, except where the law requires it.
- Fees already paid are not refundable, except where we have billed you in error.
- When you cancel, remove the call-forwarding code from your phone so your missed calls go back to voicemail. We are not responsible for calls forwarded to us after your account is closed.
7. Availability, carriers and third parties
We work to keep the Service running at all times, but we do not guarantee it will be uninterrupted or error-free. Texts usually go out within seconds, but timing is not guaranteed.
- The Service depends on your phone carrier, call forwarding, our telephony and messaging providers, and our hosting provider. Carriers may delay, filter or block messages, and we are not responsible for their networks or decisions.
- Call forwarding is a setting on your phone line. Your carrier may charge for forwarded calls; check your plan.
- We may carry out scheduled maintenance and will try to give notice of planned downtime.
- The Service is not an emergency service. Do not rely on it for urgent, safety or life-threatening calls. Our "urgent" flag is a convenience and may not catch every urgent message.
8. Disclaimers, liability and indemnity
To the extent the law allows, the Service is provided "as is" and "as available". We do not promise any number of recovered calls, jobs, revenue or return on investment. ROI figures in your dashboard are estimates based on job values you enter.
To the extent the law allows:
- We are not liable for lost profits, lost jobs, lost revenue, missed or delayed messages, lost data, or any indirect, incidental, special or consequential damages.
- Our total liability for any claim relating to the Service is limited to the fees you paid us in the 3 months before the event that caused the claim.
You agree to defend and compensate TextApprentice for claims, fines and costs (including reasonable legal fees) arising from your messages, your follow-up with callers, your breach of these Terms, or your breach of any law, including CASL and privacy laws.
9. Suspension, changes, governing law and contact
Suspension and termination. We may suspend or close your account if you break these Terms, misuse the Service, fail to pay, or if a carrier or regulator requires it. Where we can, we will tell you first and give you a chance to fix the problem. Sections 4, 5 (unpaid fees), 8 and 9 continue after your account ends.
Changes to these Terms. We may update these Terms. For material changes, we will email you at least 30 days before they take effect. If you keep using the Service after that date, the new Terms apply. If you do not agree, you can cancel under section 6.
Governing law. These Terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Disputes will be heard in the courts of Ontario.
General. These Terms and the Privacy Policy are the entire agreement between us about the Service. If any part is found unenforceable, the rest still applies. You may not transfer your account without our written consent.
